Introduction

Welcome to LensMap. These Terms of Service ("Terms") govern your access to and use of the LensMap platform, including our website, mobile applications, and related services. By using LensMap, you agree to these Terms.

About LensMap

LensMap is a platform that connects photographers ("Creators") with clients seeking photography services. We provide:

• Portfolio showcase tools for Creators
• Booking and payment processing
• Real-time messaging between users
• Location discovery features
• AI-powered assistant for recommendations

Eligibility

To use LensMap, you must:

• Be at least 18 years old
• Have the legal capacity to enter into contracts
• Not have been previously banned from our platform
• Agree to comply with these Terms and applicable laws

Your Account

Account Creation

You must provide accurate and complete information when creating an account. You may not use false information or impersonate others.

Account Security

You are responsible for maintaining the security of your account credentials. Notify us immediately if you suspect unauthorized access to your account.

Creator Profile

To offer services on LensMap, you must activate a Creator profile and comply with additional requirements, including payment setup and verification.

User Content

Your Ownership

You retain full ownership of all content you upload to LensMap, including photos, videos, and text. We do not claim ownership of your content.

License to LensMap

By uploading content, you grant LensMap a limited, non-exclusive, royalty-free license to:

• Display your content on the platform as intended
• Use thumbnails/previews to promote your profile within LensMap
• Make technical copies for backup and service delivery
• Use your content in marketing, advertising, and promotional materials for LensMap

This license terminates when you delete your content or account, except for copies that may exist in backups (deleted within 30 days) or where retention is required by law.

Promotional Use Notice

By uploading content to LensMap, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and display your content for marketing and promotional purposes, including in advertisements, social media, press releases, and other promotional materials. You will be credited where reasonably possible. You may opt out of promotional use by contacting support@lensmap.io.

Content Rules

You must not upload content that is:

• Illegal or promotes illegal activities
• Harmful, threatening, abusive, or harassing
• Infringing on intellectual property rights
• Misleading or fraudulent
• Spam or unauthorized advertising
• Containing malware or malicious code

Zero Tolerance for Illegal Content

LensMap maintains a strict zero-tolerance policy for illegal content, including but not limited to child sexual abuse material (CSAM), non-consensual intimate images, content depicting violence or exploitation, and any material that violates applicable laws. Such content will be immediately removed and reported to the appropriate law enforcement authorities. Users who upload illegal content will be permanently banned and may face criminal prosecution.

Acceptable Use

You agree not to:

• Harass, abuse, or harm other users
• Interfere with platform operations or security
• Scrape, crawl, or extract data automatically
• Impersonate others or misrepresent your identity
• Circumvent any access restrictions or security measures
• Use the platform for unauthorized commercial purposes

Bookings and Payments

Our Role

LensMap facilitates connections between Creators and clients. We are not a party to agreements between Creators and clients. Creators are independent contractors, not employees of LensMap.

Fees and Commission

LensMap charges a platform fee for transactions processed through our platform:

• Platform commission: 15% of the booking amount
• Payment processing fees charged by Stripe (passed through)
• Applicable taxes as required by law

Taxes

Creators are responsible for their own taxes. Any tax amounts shown on LensMap are estimates for convenience only and are not charged to clients.

Payment Processing

Payments are processed securely by Stripe. By using our payment features, you also agree to Stripe's terms of service.

Payout Delay

Creator payouts are delayed by 7 days after the payment is received to ensure safety and dispute handling.

Refunds and Cancellations

Refund policies are set by individual Creators. In case of disputes, LensMap may mediate but is not responsible for the outcome. Your statutory rights as a consumer are not affected.

Intellectual Property

LensMap's IP

The LensMap platform, including its design, features, and branding, is owned by LensMap. You may not copy, modify, or distribute our platform or trademarks without permission.

Your IP

You retain all intellectual property rights to your content. Photographers own the copyright to their photographs unless otherwise agreed with their clients.

Copyright Complaints

If you believe content on LensMap infringes your copyright, please contact us at legal@lensmap.com with details of the alleged infringement.

Disclaimers

To the extent permitted by law:

• We do not guarantee the quality of services provided by Creators
• The platform is provided "as is" without warranty of uninterrupted availability
• We are not responsible for third-party services or content
• We do not endorse user-generated content

Limitation of Liability

Our liability to you is limited to the extent permitted by applicable law.

Exclusions

Subject to mandatory law, we are not liable for:

• Indirect, incidental, or consequential damages
• Lost profits or business opportunities
• Loss of data (except as required by law)

Mandatory Liability (Cannot Be Excluded)

Nothing in these Terms excludes or limits our liability for:

• Death or personal injury caused by our negligence
• Intentional misconduct
• Gross negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded under applicable law

Indemnification

You agree to indemnify LensMap against claims arising from your violation of these Terms, your content, or your use of the platform.

This indemnification does not apply to the extent that claims arise from our own negligence or breach.

Termination

Your Right to Terminate

You may close your account at any time through your account settings or by contacting us. We will delete your personal data in accordance with our Privacy Notice.

Our Right to Terminate

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for other reasons with reasonable notice. We will provide notice and an opportunity to remedy violations where reasonable.

Informal Resolution

We encourage you to contact us first to resolve any issues. Many disputes can be resolved quickly through our support team at info@lensmap.io.

Online Dispute Resolution (ODR)

If you are an EU consumer, you may use the EU Online Dispute Resolution platform to resolve disputes:

Governing Law

These Terms are governed by the laws applicable to LensMap's place of establishment.

If you are an EU consumer, you will also benefit from any mandatory provisions of the law of your country of residence.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes at least 30 days in advance. Your continued use of the platform after changes take effect constitutes acceptance of the new Terms.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Notice, Cookie Policy, and any other policies referenced herein, constitute the entire agreement between you and LensMap.
